These conditions apply to all Holidays and govern your relationship with Ski Goddess Ltd. Please read them carefully before making a booking.
1) Your Holiday Contract
Your Holiday contract is made between Ski Goddess Ltd (“Ski Goddess”) and the person named on the booking form (“you”). Your “Holiday” refers to the package and Ski Goddess course booked by you or by someone on your behalf. When a booking is made, the ‘primary person’ named in the booking undertakes to accept the booking conditions on behalf of all persons named on the booking form, and acknowledges that these terms and conditions apply to all such persons.
After Ski Goddess receives your completed booking form, Ski Goddess will send you a confirmation email and an invoice for your Holiday.
When we receive your deposit payment, a binding agreement will be automatically created between Ski Goddess and the names outlined on the booking form. This contract is governed by the laws of England and Wales and is subject to the jurisdiction of the Courts of England and Wales.
Upon receipt of your confirmation letter and invoice, it is your responsibility to check that all the details are correct, and to notify us immediately if there are any discrepancies.
2) Prices and Website Accuracy
The information and pricing guidelines shown on our website are correct at the time of publication, however these may be subject to change prior to formal booking of your Holiday package. You must therefore ensure you check the price and all other details of your chosen package with us at the time of booking.
3) Insurance
It is a condition of your Holiday contract that you and all persons named on the confirmation invoice obtain adequate winter sports insurance to cover each person’s particular needs, as well as all activities that will be undertaken on the holiday. Please note that ordinary travel insurance does not automatically include winter sports activities as standard cover, and it is your responsibility to ensure this cover is in place. However, to cover all circumstances, you should ensure that the insurance policy covers skiing both on and off piste, with or without a guide (noting that it is possible to inadvertently ski off piste). Standard winter sports insurance may be sufficient for some courses such as Novice or Level 1 courses.
Your travel insurance, which must be from a reputable provider, must at least include the following: –
The policy posted on our website is available from MPI Brokers and satisfies these conditions –
http://retail.mpibrokers.com
In the event that you or any other persons within your party do not hold suitable insurance cover, we shall not be liable for any costs incurred or claims made against Ski Goddess as a result of this failure.
4) Financial Protection
Ski Goddess is a company committed to customer satisfaction and consumer financial protection. Therefore, we are pleased to announce that, at no extra cost to you, and in accordance with the current Package Travel Regulations, all passengers booking with Ski Goddess are fully insured for the initial deposit, as well as the subsequent balance of monies paid as detailed in your booking confirmation form. The policy will also include repatriation if required, arising from the cancellation or curtailment of your travel arrangements due to the insolvency of Ski Goddess.
This policy is issued by Evolution Insurance Company Limited, which is registered in Gibraltar No. 88737 with a registered office at 5/5 Crutchett’s Ramp, Gibraltar, GX11 1AA. Evolution Insurance Company Limited is authorised and regulated by the Financial Services Commission in Gibraltar and authorised and subject to limited regulation by the Financial Conduct Authority (FCA) in the UK. Details about the extent of our authorisation and regulation by the FCA are available from us upon request.
In the unlikely event of Insolvency of Ski Goddess please follow the procedures below:
Claims should be submitted in writing, supported by documented evidence quantifying the value of the claim, to: Evolution Insurance Solutions Limited, 53A High Street, Saffron Walden, Essex, CB10 1AA or via email to claims@evo-insurance.com.Policy exclusions: This policy will not cover any monies paid back to you by your Travel Insurance, or any losses which are recoverable under another insurance or bond (with the exception of credit and debit card). This policy does not cover any loss sustained by passenger(s) booked on a flight-inclusive package sold and commencing within the United Kingdom.
5) Your Holiday Price and Paying for your Holiday
The price guidelines on our website are correct at time of website publication, however, Ski Goddess reserves the right to raise or lower its prices at any time. Prior to making a formal booking, we will provide you with the current prices, including the cost of any peak-season supplements, upgrades or additional facilities which you may have requested.
The price of your Ski Goddess course and all related arrangements are calculated using the exchange rates at the time of your booking. We reserve the right to change prices where there has been an exchange rate fluctuation in excess of 2%.
A non-refundable deposit of £250 is required from you and all other persons in your party at the time of booking. The final balance must be paid 6 weeks prior to departure. If payment is not received by this date, we reserve the right to resell your place within the course and proceed with the cancellation charges set out in Section 7. Please also refer to Section 10 Force Majeure for transferring of a deposit.
6) If You Change Your Booking
If you wish to make changes to your booking arrangements in any way after our deposit invoice has been issued, we will do our best to make these changes. However, please note that this may not always be possible. Any request for changes must be communicated by the primary name on the booking. If we receive notification of such requests less than 10 weeks in advance of the Holiday commencement date, you will be asked to pay an administration fee of £30 per person (plus any further cost Ski Goddess incurs in making this alteration). Where we can meet a request for an alteration, we will confirm the amendment by email and issue a revised invoice where appropriate.
Note: Certain arrangements cannot be amended after they have been confirmed and any alteration may incur a cancellation charge of up to 100%. In some cases, major changes made to the booking may require you to pay cancellation fees and proceed with purchasing a new booking at full cost.
7) If You Cancel Your Holiday
Cancellations
Yourself, or any member of your party, may cancel their travel arrangements at any time. Written notification by email from the ‘primary name’ on the booking, must be received by Ski Goddess. As costs are incurred in cancelling your travel arrangements, you will have to pay the applicable cancellation charges provided in the diagram below.
In cases where cancellation fees charged by our suppliers are higher than the cost of the deposit, you will be responsible for paying the difference. Please ask for full details and we will notify you of the specific charges applicable to your booking. Note: certain arrangements may not be cancelled after they have been confirmed and any cancellation could incur a cancellation charge of up to 100%.
Amendments
If you would like to amend or change the date of your holiday, please notify Ski Goddess in writing as soon as possible.
We will do our best to make the change but cannot guarantee being able to do so. Please note that there will be a minimum charge of £30 per person to do so. Any additional costs arising from differences in holiday prices will also be payable.
You may transfer your Holiday package to another person, should that person satisfy all the conditions applicable to that package. In order to do so, you must give us notice in writing of your intention at least 7 days before the package is due to start. We will inform you of any additional fees, charges or other costs relating to the transfer of your Holiday.
8) Other Covid-19 Related Terms and Conditions
If you contract Covid-19 within 2 weeks of the date of travel and are forced to cancel the Holiday, you will be liable for 80% of the holiday cost. You may be able to make a claim from your own personal insurance. We know many insurers will cover Covid-19 on a personal illness basis. We would suggest that you check this with your insurer prior to booking your Holiday with Ski Goddess.
If you book a twin room and start to show any symptoms within the 2 weeks prior to travel, you must take a test. You will need to cancel your holiday if you test positive for Covid-19.
If you show symptoms of Covid-19 whilst on your Ski Goddess Holiday, you must isolate from the rest of the group, follow local guidelines and contact your insurer about medical treatment or repatriation if appropriate.
9) If We Make Changes to your Holiday
Your Holiday arrangements are planned many months in advance and on rare occasions, it may be necessary for us to make changes to your booking. Ski Goddess reserves the right to do so at any time. In the majority of cases, these changes will be minor. However, if they are of a more substantial nature, we will do our best to advise you prior to your departure. Major changes would include changes of accommodation to a lower standard. In the unlikely event of this occurring, you would be entitled to a refund equivalent to the difference in price between the original and revised booking arrangements.
10) Force Majeure
We reserve the right cancel your holiday in the event of changes caused by (but not limited to) war or threat of war; riot; civil strife; hostilities; political unrest; government action; industrial dispute; natural or other disaster; nuclear incident; terrorist activity; weather conditions including lack of snow; closure of airports; closure of pistes; closure of ski lifts; fire; flood; drought; re-scheduling or cancellation of flights and technical problems with transportation; and all similar events outside our control.
If you cannot travel due to Covid-19 related travel restrictions or resort closures inflicted by the UK Foreign Office or equivalent in your country, you will be refunded your full balance. This includes official, known restrictions of your travel from 6 weeks before travel, up to and including your day of travel.
You will also have the opportunity to transfer your deposit to another Ski Goddess Holiday if there is a suitable course before the end of April 2024.
11) Our Responsibility To You
Ski Goddess is responsible for the standard of service provided to you and has taken all reasonable steps to ensure that this service is provided with appropriate skill and care. We will accept responsibility in the event of proven negligence by employees of Ski Goddess in the course of providing these services.
Ski Goddess cannot accept any liability for loss, damage or expenses as a result of Force Majeure or other events outside Ski Goddess’ control. Ski Goddess will not be liable for any damages arising from death, injury or illness or for any breach of contract if such circumstances are due to unusual and unforeseeable circumstances beyond our control. This may arise where the consequences of such damage or loss could not have been avoided even if all care had been exercised, or due to an event which, even with all due care, could not be foreseen or forestalled.
Ski Goddess will not accept responsibility for any extra activities, services or facilities which do not form part of the Holiday or where they are not advertised in our website. Please note that this also includes all hazardous activities.
12) Conduct
When you book a Holiday with Ski Goddess, you accept responsibility for the proper conduct of yourself and your party whilst on Holiday. If Ski Goddess, or any other person operating under it’s authority, is of the reasonable opinion that you or any member of your party is behaving in such a way as to cause, or be likely to cause, distress, danger or annoyance to any other person, including other guests, employees or other third parties, or damage to property, we will be entitled to terminate the Holiday of the person(s) concerned. You will be responsible for making full payment for any damage or loss caused by you or any member of your party during your Holiday.
13) If You Have A Complaint or Dispute
Your Holiday is extremely important to us. However in the unlikely event that you have any reason to complain or experience any problems with your booking arrangements whilst away, you must immediately inform Katie Dobson or a member of our team. You can also write to us within 28 days of your return with full details to: katie@skigoddess.co.uk or to Ski Goddess Ltd, First Floor, Unit 12 Compass Point, Ensign Way, Hamble, Southampton SO31 4RA. If there are any claims or disputes, we will do our best to reach an amicable situation as soon as possible. Any claims or disputes that cannot be resolved successfully between Ski Goddess and the client will be taken to an official arbitrator.
14) Data Protection/Privacy
Any information that you give to Ski Goddess is used solely for the purposes of arranging your Holiday. In order to process your booking and meet your requirements, Ski Goddess must pass your personal details on to the relevant suppliers of your course. Ski Goddess will also keep your contact information for our own future marketing purposes (for example, to inform you of promotional offers or new course dates). If you do not wish to receive such information in future, please inform us as soon as possible.
15) Special Requests
If you wish to make a special request, you must do so at the time of booking. We will pass any reasonable requests onto the relevant supplier but we cannot guarantee that requests will be met. The fact that a special request has been noted on your booking form, invoice or any other documentation is not confirmation that the request will be met. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed.
16) Health Medical Issues and Disabilities
If you have any medical conditions, health issues or disabilities which may affect your health and safety on the course, or your ability to participate, please inform Ski Goddess at or before the time of booking, so that we can advise upon the suitability of the chosen Holiday and/or course. You must also notify Ski Goddess of any deterioration of such medical condition or disability. In the event that the particular needs of the person render Ski Goddess unable to properly accommodate, the right is reserved by Ski Goddess to decline the booking. Moreover, if full details are not given at the time of booking, Ski Goddess reserves the right to cancel the booking once we become aware of these details.
